Citizenship and Enrolment
The Toquaht Nation Citizenship Act allows the Citizenship and Enrolment committee to determine who is eligible to become a Toquaht citizen.
A person can apply to become a citizen of the Toquaht Nation (“a citizen”), and they can apply to enroll in the Maa-nulth Treaty (“an enrollee”) and adhere to its principles.
A person can choose to become a Toquaht citizen without enrolling in the Maa-nulth Treaty.
A person who chooses to be an enrollee in the Maa-nulth Treaty will automatically be considered a Toquaht citizen.
Eligibility for Toquaht Citizenship
A person is eligible to become a Toquaht citizen if that person:
- was on the Toquaht band list as of March 31, 2011 (the day before the Maa-nulth treaty took effect),
- has been adopted as a child by a Toquaht citizen under Canadian law, the Maa-nulth Treaty or in accordance with Nuu-chah-nulth customs, or
- is a descendant of a Toquaht citizen.
Eligibility for Maa-nulth Treaty Enrolment
A person is eligible to enroll in the Maa-nulth Treaty if that person:
- is of Toquaht ancestry,
- was adopted (under laws recognized in Canada or in accordance with Toquaht customs) by someone who is enrolled or is eligible for enrolment,
- is a descendant of an individual of the Toquaht Nation who is eligible for enrolment, or
- is accepted by the Toquaht Nation as a member in accordance with Toquaht customs and has a demonstrated attachment to the Toquaht community.
Applying for Toquaht Citizenship or Maa-nulth Treaty Enrolment
Those interested in applying to become a Toquaht citizen or enrollee in the Maa-nulth Treaty should carefully review our Citizenship Act to confirm their eligibility.
To initiate the process to become a Toquaht citizen and/or Maa-nulth Treaty enrollee, complete the Citizenship and Enrolment Application Form and submit with any required documentation to Naomi Mack at naomim@toquaht.ca.
Review and Decision
Applications are reviewed by the Citizenship & Enrolment Committee who may either:
- Approve your request,
- Deny your request,
- Ask for more information, or
- Conditionally approve your citizenship and/or enrolment.
Conditional Approval
Applicants who are members of another First Nation or are enrolled in another self-government agreement in Canada may be granted conditional approval and given time to unregister or unenroll from the other First Nation or self-government agreement. You cannot be a citizen of two First Nations at the same time, or enrolled in more than one self-government agreement at the same time.
Renouncing Toquaht Citizenship or Maa-nulth Treaty Enrolment
Citizens who wish to renounce their citizenship in the Toquaht Nation or their enrolment in the Maa-nulth Treaty should complete the Citizenship and Enrolment Notice of Renunciation Form and submit it with any required documentation to Naomi Mack at naomim@toquaht.ca.
